"Rancho San Miguelito" AVILA Estate,  a/k/a "Rancho De San Miguelito", is part of the original 22,000 acre Spanish / Mexican land grant, (PLC 309), that was claimed and occupied by Miguel Avila, All rights, title and interest being derived from grants therefrom Juan Alverado-1842, Manual Micheltorena-1844, and  Pio Pico-1846, former Governors of California, after the war 1848, claims and titles were subsequently subject to provisions pursuant an Act of Congress approved March 3, 1851, filed two claims in the  U.S. Southern District Court of California, whereby on an appeal from said district court, the Supreme Court rendered a final decree and acknowledged  the claims and titles to the property described by a true and accurate survey of  Lots 37, 39 & 41, of townships 31 & 32 South, Range 11 & `12 East, all of Mount Diablo base and meridian, a deposit of $335.00 paid in legal tendered notes by Miguel Avila, February 28, 1866, to the clerk of the land court, for the survey of Rancho San Miguelito, commenced June 1866, by C.T. Healy  and completed February 28, 1875, by Deputy Surveyor R.R. Harris, approved and authorised under supervision of U.S. Surveyor General, Jas F. Stratton, who verified the field notes of the final survey boundary line between the public domain and the severed lots incorporated therefrom said grants, Finally Confirmed to Miguel Avila, heirs and assigns forever, ALL RIGHTS, TITLE AND SECURITY INTEREST In the property described within the Official PLAT 10 409, of Rancho San Miguelito, G47 Book, Final Survey #335, of Vol. 280 Pg. 761, Conveyed by Land Patent Accession SN: CACAAA103225, Feb. 23, 1877, IS CONCLUSIV






 Miguel Avila, Patentee and Claimant, heirs and assigns forever, have a vested security interest in first certificate of title to the entire plat of property, includes "Avilas House", United Lots, 37,39&41, with survey #335, and patent "ACCESSION" SN, ALL rights, title and interest being subject to certain statutes, regulations of an Act 31st Congress Session II. Ch. 41 15th Section, that were part of a treaty transaction, perfects a security interest in the title to all the land conveyed by a land patent under Article 9 UCC 9-311, 9-335, 

  " Accession " means goods that are physically united with other goods in such a manner that the identity of the original goods is not lost.

the filing of a financing statement is not necessary or effective to perfect a security interest in property subject to:

(1) a statute, regulation, or treaty of the United States whose requirements for a security interest's obtaining priority over the rights of a lien creditor with respect to the property preempt .

 (3) a statute of another jurisdiction which provides for a security interest to be indicated on a certificate of title as a condition or result of the security interest's obtaining priority over the rights of a lien creditor with respect to the property. 

(b) Compliance with the requirements of a statute, regulation, or treaty described in subsection (a) for obtaining priority over the rights of a lien creditor is equivalent to the filing of a financing statement under this article.  

Therefore, any subsequent "Boundary  Agreement",or "Purchase Agreement" or "Sheriffs Deed" or any "Supplemental Memorandum of first Mortgage Indenture ", or any "Syndicate Conservation Easement Transactio9ns, or "Trustee Sale" "Deed", "Assignment" "Grant", or "Deed" to convey any right, title or interest Executed after February 23, 1877, never consummated.
